The initiative was since 2005 in Congress and was reactivated, in January 2021, by the Women's and Senate Gender Commission.Thus, after 16 years, the Chamber of Deputies dispatched the bill that allows the mother's last name to precede that of the father.An election that both parents can make when their first child is born and that will govern for all common children.
If there is no agreement, the rule establishes that, when registering the first child or daughter, it is understood that the last name will be the father, which will be determined for the offspring they have in common.
In addition, the new law allows people over 18 to also request the change in order of last names, but alone for once.
Likewise, it prohibits those who are prosecuted, formalized and convicted can change their last name, in order to avoid trying to eliminate their criminal records.This last motion - which presented the government - was a modification that the Senate made to the project on April 13.
In the case of resident foreigners, for the change of order of the surnames it will govern a special norm: they can only request the modification for the purposes of issuing or rectification of their Chilean documents.
