Being a father or mother when you are unemployed is not desirable, but it happens. If it happens while you are receiving a contribution-level unemployment benefit, it is mandatory to notify the State Public Employment Service (SEPE). But what about that help? Is it lost if the benefit for the birth of a child begins to be collected? Do you have to choose between one or the other?
In this regard, the Ministry of Inclusion, Social Security and Migration has wanted to clarify it through its official Twitter profile. “If you receive an unemployment benefit at a contributory level and you meet the other requirements, you must request its suspension from the SEPE and request the birth benefit from the INSS.”
Thus, once the new situation has been reported, the unemployment benefit will be suspended and the National Social Security Institute (INSS) will be responsible for paying the maternity or paternity benefit.
During this period in which they pay Social Security, the worker does not have the obligations of a job seeker (attend mandatory training courses, job orientation sessions or mandatory job offers) and no days of those remaining to be collected are consumed from the stoppage. "When he finishes, he will be able to resume the suspended benefit and receive the same amount during the time he had left before the suspension," they explain from the SEPE.
-In the case of maternity, the Family Book or document that proves the adoption or fostering, or maternity report, or any document that proves this situation.

-You will receive a copy of the request for withdrawal submitted, stating the date and reason for the withdrawal.
With this document, you must go to the corresponding INSS office to request the maternity/paternity benefit, since it is the INSS that approves and pays the maternity and paternity benefits of the people who are receiving the contributory unemployment benefit.
Once the maternity/paternity period has ended, and after reactivating the demand for employment, you have 15 days to request the resumption of the unemployment benefit.
If requested outside this period, it will be resumed from the date of request and will entail the loss of as many days of benefit as median between the date on which the maternity/paternity benefit has ended and the date of presentation of the application.
