The benefit for the birth and care of the minor aims to protect the periods of rest and permits derived from the birth of a child, adoption or guardianship for adoption purposes, and foster care. A rest period that can be taken all at once, continuously or divided into several sections. In both cases you can enjoy part time or full time. To do this, you had to go in person to a Social Security office to request rest in various periods.
Now, however, Social Security has announced that it can be done without the need to travel. It can be processed through the Tu Seguridad Social portal (allows the telematic request for this benefit with a digital certificate or permanent Cl@ve username and password), which has enabled the option of requesting successive rest periods, in the event of the parents who choose to split this period. “With the extension of the service for successive periods, the resolution of the request is speeded up, in addition to avoiding unnecessary travel and waiting, at a time when health security measures advise reducing face-to-face care in offices. Currently, 20% of these benefits are enjoyed in successive periods », they explain from this administration.
If you do not have a digital certificate or permanent Cl@ve, you can always process this successive rest period at a Social Security Service and Information Center (CAISS) by appointment. In this case, it will be necessary to present the application form for enjoyment in multiple periods, which you will find and the rest of the documentation.
However, they advise all users in this situation to request the issuance of a digital certificate or permanent Cl@ve in future appointments, in order to carry out all subsequent procedures without having to travel. The request for the issuance of a digital certificate or permanent Cl@ve can be made at a CAISS as an independent procedure by requesting an appointment, as it requires in-person issuance.
Finally, successive rest periods can also be requested electronically without a digital certificate through a form, attaching the request and the required documentation.
Social Security remembers what is the current duration of the permit for cases of birth. A period of 16 weeks in the case of biological mothers, in which the first 6 weeks are mandatory right after delivery and full time. In the case of the other parent, the period is 16 weeks in which the first 4 are compulsory, after childbirth and also full-time.
In cases of adoption or foster care, the parents will have between them a total of 28 weeks, 6 of them mandatory for each of the parents. In this case, they clarify that there are certain exceptions such as in the case of single-parent families or the transfer of rest periods.
