Opinion: Law that allows change in the order of surnames.

The year 2022 brought us news in the field of identification, since from now on we have the option of registering as the first surname the maternal or paternal in the birth certificate of our son or daughter.Also, it is possible that any person of legal age requests, once, before the Civil Registry and identification the change of order of their surnames, that is, the rectification of their birth certificate by administrative route.This, thanks to the entry into force of Law 21,334 and its Regulation Decree 105.
The parents will have this option with the minor firstborn, because if other common sons or daughters were born, the order of the surnames that was determined for the first will be maintained.Now, in the case of a person interested in rectifying his birth certificate, he must submit the application through the virtual channels established by the Civil Registry and Identification Service, or in person in any of his offices.If the rectification is accepted, the game will be changed, without altering the RUT, and the old documents will be blocked, so a new identity and passport card will require.
It should be borne in mind that this modification will cause the change of the respective surname for the transmission of their minor children, but considering the manifestation of consent of the children older than 14 years and under 18.
It is important to mention that this new law has several virtues, meaning an advance in equal duties and rights between parents, which encourages the agreement between the parents, recognizes the autonomy of the person of legal age to rectify their birth certificate and,In addition, it respects the will of sons and daughters over 14 and under 18, to alter or not the order of their surnames.
This means progress, because it allows people to have a name that really identifies them with their inner being, contributing to the harmony and respect that must exist between what is registered in a document and their sensations and desires, and identify with the other members ofSociety according to your preference.
