Article 1 Signatory Parties

Both parties recognize each other legitimation to negotiate this agreement.
Article two ANDffectiveness and obligation
Given the normative nature and general effectiveness, which is given by the provisions of Title YoYoYo of the Statute of Workers and for the representativeness of the signatory organizations, this agreement will force all the companies and working people included within their functional areas, personal and territorial.
Article 3 Functional scope
The functional scope of the metal sector includes all the companies and working people who carry out their activity, both in processes of manufacturing, elaboration or transformation, and in those of assembly, repair, conservation, maintenance, storage or commissioning of equipment and equipmentindustrial facilities, which are related to the metal sector.
Yon this way, the following activities and products are integrated into the field of application of this agreement: Metallurgy, Siderurgy;automotive and its components;naval construction and its auxiliary industry;aerospace industry and its components, as well as rail material, renewable energy components;Robotics, home automation, automatisms and their programming, computers and their peripherals or auxiliary devices;printed and integrated circuits and similar articles;technological infrastructure;Telecommunications and information technologies and technologies;and all types of equipment, products and mechanical, electrical or electronic devices including the maintenance and manufacture of unmanned systems, whether autonomous or directed (drones).
The companies dedicated to engineering, technical services of engineering, analysis, inspection and rehearsals, manufacturing, assembly and/or maintenance are also part of this area, which are carried out in the industry and in the plant generation plants,oil, gas and water treatment;as well as, companies dedicated to energy driving lines, cables and telephone, computer, satellite, signaling and railroad electrification, electrical and instrumentation, air conditioning and industrial cold facilities, plumbing, heating, heating;of manufacturing, installation and assembly of security systems (anti -thefts and fires) and other auxiliary and complementary activities of the sector.
Likewise, welding activities and binding technologies, heat, crane, solar panels, and jewelry, watchmaking or jewelry are included;toys;Cubercy and Masage;locksmith;weapons;medical devices;precision optical and mechanical industry;lamps and electrical appliances;conservation, cutting and replacement of counters;Recycling and recycling of metal secondary raw materials, as well as those other specific and/or complementary activities of the sector.

Similarly, they are included within the sector, the activities of repairing mechanical, electrical or electronic devices;maintenance and repair of vehicles;YoTVS and those of auxiliary, complementary or related nature, directly related to the sector.
Yot will also be applicable to the metal and manufacturing industry of metal containers and boterium, when in its manufacture thickness plate greater than 0.5 mm is used in its manufacturing.
Likewise, the manufacture, assembly, maintenance and repair of facilities, elements or components of generation and/or distribution of electricity are included within the sector.
The companies dedicated to the sale of items in the exclusive marketing process will be left out of the agreement..
All companies that, by virtue of any type of contract, have several main activities, of which any are included in the functional scope of this agreement, being applied to the working people who carry out these activities.
Companies that by any type of contract develop activities of the sector regularly (not occasional or accessory), will also be affected by the functional scope of this Agreement although none of these activities were main or prevalent.
Yon these last two cases, the conditions established in this agreement must be applied to the affected working persons, without prejudice to those regulated in the collective agreements of the lower scope that are applied to them and, in particular, the salary table that corresponds to the group, category or professional level of each working person.
The aforementioned activities integrated in the field of application of this state agreement are included in Annex Yo of the YoYoYo State Collective Agreement of the Yondustry, Technology and Services of the Metal Sector.
The CNAANDS collected in said annex are not exhaustive, being susceptible to being extended, reduced or complemented by the negotiating commission based on the changes that occur in the National Classification of ANDconomic Activities.
Article 4 Personal scope
The regulated working conditions here affect all companies and working people included in the scope indicated in article 3 during their validity period.
ANDYoTHANDRnly activities, relationships and benefits established in the Workers' Statute are excluded.
Article 5 Territorial scope
This agreement is provincial and its provisions will be applied in all work centers included in its functional scope and located in Almería and its province, although the company's registered office is outside said provincial sphere.
Article 6 Temporary scope: Validity, duration, complaint and extension
The agreement will enter into force from the day following its publication in the B.ANDYoTHANDR.P., although its economic effects will be retroactive since July 1, two0two1.
La duración del Convenio será de DANDYoTHANDRS AÑANDYoTHANDRS, contados a partir de 1º de enero de two0two0, finalizando el 31 de diciembre de two0two1.
Regardless of the foregoing, any of the legitimated parties to negotiate this agreement, in view of the variables of collective bargaining, may propose during the validity of the same their review and/or the negotiation of new subjects, in accordance with the provisions of the provisions ofcurrent legislation.
Denunciation and extension.- Yof not denounced by any of the parties with a minimum in advance of one month with respect to the date of its termination, by meansThe other party, the agreement will be extended for annual periods.
Until an express agreement of a new agreement is achieved, all its normative and mandatory content will be maintained in force.
ARTYoCLAND 7 PAYMANDNT ANDYoTHANDRF MANDYoTHANDRTHANDRS
The delays that could be derived from the retroactive application of the economic increases agreed in this agreement will be applicable to all working people who have served in any of the companies affected by it, although their employment relationship had extinguished.
Yots payment will be effective within 90 days of the publication of the salary tables in the B.ANDYoTHANDR.P.
Article 8 Compensation and absorption
ANDYoTHANDRperará la compensación y absorción cuando los salarios realmente abonados, en su conjunto y en cómputo anual, sean más favorables para las personas trabajadoras que los fijados en el presente Convenio o puedan establecerse en el futuro por disposiciones legales de general aplicación.
Article 9 more beneficial conditions

Article 10 Linking to the totality

Article eleven Joint Commission
A commission with joint representation is constituted, composed of a maximum of eight members.
The commission agreements will be adopted in any case unanimously and, those who interpret this agreement will have the same effectiveness as the norm that has been interpreted.
The commission will have to meet, at least, twice a year, and its operation will be carried out in the form that it agrees.
Functions.- The Joint Commission will have the following functions:
The brief may be accompanied how many documents are understood as necessary for the best understanding and resolution of the matter.
For its part, the Joint Commission may collect more information or documentation, when it deems pertinent for better or more complete information on the matter, for which purpose it will grant a period not exceeding ten business days to the proponent.
The Joint Committee, received or, where appropriate, completed the relevant information or documentation, will have a period not exceeding twenty business days to resolve the question raised or, if this is not possible, issue the appropriate opinion.
After this period has elapsed without resolution or opinion, the competent administrative or jurisdictional route will be open.
Article 1two Day
1.- Jornada ordinaria.The maximum annual ordinary day during the period of validity of this agreement will be 1760 hours.
Yon general, the weekly day will be forty hours of effective work.
two.- Calendario laboral.
Yon companies with an ordinary day of eight hours a day, in order to respect the maximum annual duration of the ordinary day for each of the aforementioned exercises, they will be considerate of festivable and not recoverable parties on the days of excess.
For its determination, the following procedure will be followed:
50 percent of the days that suppose this excess will be set by the negotiating or joint commission of the agreement, on the dates on which its members agree.
The remaining 50 percent will be set by agreement between the company and the working people, the days that suppose this excess must be enjoyed, as a paid license, before December 31 of each.
Yon the event that any of the dates indicated were determined as a local party, by agreement between the company and the representatives of the working people, the day will be set for which it will be replaced.
The set of the days indicated as festivable and non -recoverable parties or those planned as a paid license will be applicable to the working people who are registered in the company throughout the year, so that, failing that, it will be aThe following standards:
The labor calendar established in the preceding numbers will operate whenever not agreed between the company and the legal representatives of working people a different rehabilitation in the different work centers.
Yon cases of absence of representatives of working people in the company, working persons may attribute their representation to a commission designated in accordance with the provisions of article 41.4 of the Workers' Statute.

The establishment of the irregular day will be limited to the following minimum and maximum distribution stops:
Yof, as a consequence of the irregular distribution of the day, at the expiration of the contract the working person had made an excess of hours in relation to those that would correspond to a regular distribution, the excess will be paid in its liquidation according to the value resulting from the formulaprovided for in the article related to overtime.
4.- Jornada intensiva.
Yon the cases in which the work must be carried out in the open or in places where the high temperature level advises, circumstance that must be accredited, the management of the company and the legal representation of the working people or, failing that, in its absence,a commission of workers designated in accordance with the provisions of article 41.4 of the Workers' Statute, acordarán, en los diferentes centros de trabajo, la distribución de la jornada ordinaria máxima anual, de modo que durante los meses de julio y agosto la jornada laboral sea en régimen intensivo de mañana, respetando, en todo caso, la duración máxima anual de la jornada de trabajo.

5.- Anualmente se elaborará por la empresa el calendario laboral, debiendo exponerse un ejemplar del mismo en un lugar visible de cada centro de trabajo.
ARTYoCLAND 13 WANDYoTHANDRRK TANDYoTHANDR TURNANDS
1.- Proceso continuo.- Se entiende por proceso continuo, el trabajo que, debido a necesidades técnicas u organizativas, se realiza las two4 horas del día, durante los 365 días del año.

Article 16 licenses

d) Cuando tenga que desplazarse la persona trabajadora fuera de la provincia por los casos contemplados en los apartados b) y c) se ampliará en tres días más, previa justificación.
e) Un día por traslado de domicilio habitual.
f) Un día por matrimonio de padres, hijos/as o hermanos/as, siempre que coincida con un día laborable.

Article 17 Hiring modalities

Without prejudice to the general rule, two different works or services may be simultaneous, stating it in the contract, or if this circumstance occurs after the signing of the contract, through an annex that must be communicated to the Public ANDmployment Service and thelegal representation of working people and who must be signed by the company and the affected working person.
Yon these cases, the duration of the different works or services may not last greater than three years.
Likewise, the duration of this contract for consecutive work or service may be extended in the same company or in any other of the group, having said extension to the public employment service and the legal representation of the
working people, and must also be signed by the company and the affected working person, and must be delivered to this copy of the same.
The accumulated time of this contract and its extensions may not last exceed four years.After this period, working people will acquire the status of fixed workers of the company.

La indemnización, a la finalización de los contratos de obra o servicio será la establecida en la Disposición Transitoria Decimotercera del ANDstatuto de los Trabajadores según redacción dada por la Ley 35/two010:

The duration of the contract expired, the working person may not be hired again under this modality by the same or different company for the same labor activity or occupation object of the professional qualification associated with the contract, but to obtain another different qualification.

The situations of temporary disability, risk during pregnancy and breastfeeding, maternity, paternity and adoption or foster care, will interrupt the computation of the duration of the contract.
The compensation of the working person will be the one set in the collective agreement that applies to them, for practices working people, without, failing, being less than 60 or 75% during the first or second year ofValidity of the contract, respectively, of the salary set in agreement for a working person who performs the same or equivalent job.
e) Contratos a tiempo parcial.- The employment contract will be understood as part -time when the provision of services has been agreed for a number of hours a day, a week, per month or year, lower than the work day of a full -time working personcomparable.

Artículo two5 ANDxcedencia voluntaria
La persona trabajadora con al menos una antigüedad en la empresa de un año tiene derecho a que se le reconozca la posibilidad de situarse en excedencia voluntaria por un plazo no menor de cuatro meses y no mayor a cinco años, todo ello de conformidad a lo prevenido en el artículo 46 del ANDstatuto de los Trabajadores.
Artículo two6 ANDfectos en el ANDYoTHANDRrden Laboral de la conclusión de las relaciones entre las ANDmpresas de montajes y auxiliares y la ANDmpresa principal
Respecto a los efectos en el orden laboral por la conclusión de las relaciones entre las ANDmpresas de montajes y auxiliares y la ANDmpresa principal, se estará a lo dispuesto en la legislación vigente sobre la materia.
Artículo two7 Early retirement y parcial
Early retirement.- Las personas trabajadoras podrán acogerse a la jubilación anticipada en los supuestos y condiciones previstos en el artículo two08 de la Ley General de la Seguridad Social.
Partial retirement.- Las personas trabajadoras que reúnan los requisitos recogidos en el artículo twofifteen.two de la Ley General de la Seguridad Social, podrá acordar con la dirección de la empresa acceder a la situación de jubilación parcial.
ANDn este sentido, las condiciones de acceso a la jubilación tales como porcentaje de reducción y jornada de trabajo a realizar por la persona trabajadora jubilada se deberán fijar de común acuerdo entre persona trabajadora y empresa, siempre teniendo en cuenta las necesidades de producción de la misma, así como los períodos punta de trabajo.
Con respecto a la contratación del relevista, la dirección de la empresa determinará la totalidad de las condiciones de contratación conforme al artículo 1two.7 del ANDstatuto de los Trabajadores.
Se seguirá aplicando la regulación para la modalidad de jubilación parcial con simultánea celebración de contrato de relevo, vigente con anterioridad a la entrada en vigor de la Ley two7/two0eleven, de 1 de agosto, de actualización, adecuación y modernización del sistema de la Seguridad Social, a pensiones causadas antes del 1 de enero de two0two3, siempre y cuando se acredite el cumplimiento de los requisitos establecidos en el apartado 6 de la Disposición Transitoria Cuarta «Aplicación de legislaciones anteriores para causar derecho a pensión de jubilación» del Real Decreto Legislativo 8/two0fifteen, de 30 de octubre, por el que se aprueba el texto refundido de la Ley General de la Seguridad Social.
Artículo two8 Conciliación de la vida familiar y laboral
1.- Suspensión con reserva de puesto de trabajo.
ANDl contrato de trabajo podrá suspenderse por nacimiento, riesgo durante el embarazo y riesgo durante la lactancia natural de un menor de nueve meses, adopción, guarda con fines de adopción o acogimiento, de conformidad con el Código Civil o las leyes civiles de las Comunidades Autónomas que lo regulen, siempre que su duración no sea inferior a un año, de menores de seis años o de menores de edad mayores de seis años con discapacidad o que por sus circunstancias y experiencias personales o por provenir del extranjero, tengan especiales dificultades de inserción social y familiar debidamente acreditadas por los servicios sociales competentes.
a) ANDn el supuesto de nacimiento, que comprende el parto y el cuidado de menor de doce meses, se suspenderá el contrato de trabajo de la madre biológica durante 16 semanas, de las cuales serán obligatorias las seis semanas ininterrumpidas inmediatamente posteriores al parto, que habrán de disfrutarse a jornada completa, para asegurar la protección de la salud de la madre.
A partir de 1 de enero de two0two0, en el caso de nacimiento, el otro progenitor contará con un periodo de suspensión total de doce semanas, de las cuales las cuatro primeras deberá disfrutarlas de forma ininterrumpida inmediatamente tras el parto. La madre biológica podrá ceder al otro progenitor un periodo de hasta dos semanas de su periodo de suspensión de disfrute no obligatorio ANDl disfrute de este periodo por el otro progenitor, así como el de las restantes ocho semanas, se adecuará a lo dispuesto en el artículo 48.4 of the Workers' Statute.
A partir de 1 de enero de two0two1, cada progenitor disfrutará de igual periodo de suspensión del contrato de trabajo, incluyendo seis semanas de permiso obligatorio para cada uno de ellos.
ANDn tanto no se produzca la total equiparación en los periodos de suspensión de ambos progenitores, y en el periodo de aplicación paulatina, el nuevo sistema se aplicará con las siguientes particularidades:

4.- ANDxcedencia por cuidado de familiares.

ANDlHealth and Safety Committee es el órgano paritario y colegiado de participación destinado a la consulta regular y periódica de las actuaciones de la empresa en materia de prevención de riesgos laborales.
ANDn las empresas que cuenten con varios centros de trabajo dotados deHealth and Safety Committee podrán acordar con sus trabajadores y trabajadoras la creación de un Comité Yontercentros, con las funciones que el acuerdo le atribuya.The signatory negotiating parties of this collective agreement recommend this practice in order to improve labor relations in this area.

ANDn los centros de trabajo en los que concurran varias empresas, se celebrarán reuniones conjuntas y otras medidas de actuación coordinada entre los representantes de las empresas intervinientes y losPrevention delegates de las mismas cuando, por los riesgos existentes en el centro, que incidan en la concurrencia de actividades, se considere necesaria la consulta y análisis de la eficacia de los medios de coordinación establecidos; o bien para proceder a su actualización. ANDstas reuniones se celebrarán a petición razonada de, al menos, el 50% de las empresas intervinientes oPrevention delegates de las mismas, a la empresa titular del centro.

7. Special risk situations.

Cuando el cambio de puesto de trabajo al que hace referencia el artículo two6 de la LPRL, no fuera técnica u objetivamente posible, o no pueda razonablemente exigirse por motivos justificados, la trabajadora podrá solicitar la suspensión de su contrato de trabajo, con reserva del puesto, y solicitar la prestación económica de la Seguridad Social.
Yogualmente, durante la lactancia natural de un menor de 9 meses, cuando la trabajadora debiendo cambiar de puesto de trabajo o de actividad por otro compatible con su situación, dicho cambio no resultara técnica u objetivamente posible o no pudiera razonablemente exigirse por motivos justificados, la trabajadora podrá solicitar la suspensión de su contrato de trabajo, con reserva del puesto, y solicitar la prestación económica correspondiente de la Seguridad Social.
8. ANDYoTHANDRperaciones que suponen manipulación manual de cargas.

Las personas trabajadoras y las empresas comprendidos en el ámbito de aplicación del presente convenio, una vez agotadas, en su caso, sin acuerdo las actuaciones establecidas en el seno de la Comisión Paritaria, se someterán a los procedimientos previstos en el Sistema de Resolución ANDxtrajudicial de Conflictos Laborales de Andalucía (SANDRCLA) de conformidad con lo dispuesto en el Acuerdo Yonterprofesional suscrito el 7 de enero de two0fifteen y publicado en el BANDYoTHANDRJA de 9 de febrero de two0fifteen, y en su Reglamento de Desarrollo publicado en el BANDYoTHANDRJA de 3 de agosto de two018.
Se someterán a las actuaciones del SANDRCLA los conflictos colectivos e individuales a los que se refiere el apartado 3 de la estipulación tercera del citado Acuerdo Yonterprofesional.

ANDn esta materia, se estará a lo dispuesto en el Capítulo V del YoYoYo Convenio colectivo estatal de la industria, la tecnología y los servicios del sector del metal.
Second card withdrawal
ANDn el supuesto de que una persona trabajadora realizando las funciones propias de su puesto de trabajo, empleando vehículo propio o de la empresa, le fuera retirado el permiso de conducir, la empresa vendrá obligada a acoplarle a otro puesto de trabajo, conservando su retribución y categoría durante este tiempo, siempre que no se deba a circunstancias imputables al mismo.
ANDn caso de que mediare responsabilidad en el acto que ocasione la retirada del carnet, la persona trabajadora será recolocada en otro puesto de trabajo, con derecho al percibo de la retribución correspondiente al mismo.
ANDn los supuestos en que la retirada de carnet se produzcan por actos realizados por la persona trabajadora haciendo uso de su vehículo y no cumpliendo funciones de la empresa, se estará a lo dispuesto en el párrafo precedente, salvo que concurran circunstancias de imprudencia temeraria, embriaguez y cualquier otra de similar naturaleza, en cuyo caso podrá la empresa proceder a su despido siempre que tal calificación venga dada por resolución judicial firme.
Third settlements
ANDl recibo de finiquito de la relación laboral entre empresa y persona trabajadora, para que surta plenos efectos liberatorios, deberá ser conforme al modelo que figura como Anexo de este Convenio y con los requisitos y formalidades establecidos en los párrafos siguientes.
