    The Provincial Delegation of the Ministry of Economy, Companies and Employment in Albacete of the Board of Communities of Castilla-La Mancha, agrees:

    CONVENIO COLECTIVO DE CUCHILLERÍA Y AFINES DE LA PROVINCIA DE ALBACETE2020/2022

    Chapter I Areas, Validity, Joint Commission and Autonomous Solution of Labor Conflicts

    Preliminary article.- Determination of the parties

    They are signatory parts of this agreement, for business representation, Association of Businessmen of the Knind.Oo.) and the General Workers Union (UGT).

    Article one.- Area of ​​application

    This agreement will affect all the companies and workers of Albacete and its province, dedicated to the activity of a knob, both in the production process and in the transformation of its various aspects, also including those companies, work centers, work centersor workshops in which work of auxiliary, complementary or related clashes are carried out.

    Article2.- Validity and duration

    The validity of this Agreement will include from January one,2020 to December 3one,2022.Notwithstanding the foregoing, and, in avoidance of the normative vacuum that in another case would occur, once its initial validity, or that of any of its extensions, will continue to continue, in its entirety, its normative content, until it was replaced byother.

    This Agreement may be denounced by the signatory parties on any date within the last two months to the end of its initial validity or that of any of its extensions.

    Article 3.- Joint Commission

    The joint commission referred to in article 85.3section e) Y9one.3of the Statute of Workers, will be made up of four representatives of the workers and four other employers, being able to appoint a president for their deliberations, adopting the agreements by consensus.

    Its functions will be the following:

    Both parties agree to give knowledge to the Joint Commission of how many doubts, discrepancies and conflicts occur as a consequence of the interpretation of the agreement.

    The issues of their competence that are raised to the Joint Commission must be submitted in writing, and its content will be the necessary so that it can examine and analyze the problem with knowledge of cause, and must have as a mandatory minimum content:

    The consultation brief will be accompanied how many documents are understood as necessary for the best understanding and resolution of the problem.

    The Commission may collect, by means of extension, how much information or documentation it deems pertinent for a better or more complete information on the matter, for which purpose it will grant a term to the proponent that may not exceed five business days.

    The Joint Commission, once the consultation document is received or, where appropriate, complemented the relevant information, will have a period not exceeding twenty business days to resolve the issue raised or, if this is not possible, issue the appropriate opinion.After this period has elapsed without resolution or opinion, the competent administrative or jurisdictional route will be open.

    The Commission must be subject to the norms established in the III Asac, as well as, ultimately to the labor authority and jurisdiction.

    The registered office of this Joint Commission will be in the premises of the Association of Businessmen of the Cuzzería (appreciation) main address in: Adeca.Campollano Business Park.G, Nºone, 02007Albacete.

    Article 4.- Agreement Autonomous Solution of Labor Conflicts (III ASAC)

    The signatory parties of this agreement adhere to the III Autonomous Labor Conflicts Solution Agreement of Castilla-La Mancha (III ASAC, Docm, No. 55, of March20,20one4), as well as its application regulations that will link to the totalityof companies and all the workers represented, acting in the first instance the joint commission of this agreement.

    CHAPTER II WORKING CONDITIONS AND TIME

    Article 5.- Workday

    The maximum annual workday during the validity of this agreement will be one.772hours per year.

    The distribution of the annual day, as well as the weekly breaks, holidays and vacations, will be set at the corresponding labor calendars between the company and legal representatives of the workers during the first three months of each year.

    Article 6.- Holidays

    Article 7.- Licenses

    The workers to whom the agreement is applied will be entitled to paid permission (more antiquity base salary, where appropriate), in the following assumptions:

    Chapter IIiretribuciones

    Article 8.- Base salary

    During the validity of this agreement, the base salary of each of the professional groups will be the one that establishes the annexed tables of this agreement with a normal work day.By2020, the same salary tables of20one9 are maintained.

    Article 9.- Extraordinary bonuses

    Article one3.- Diets

    Without distinction of categories, the workers who carry out displacements with stay, outside the municipal term in which the company is located, will receive, for this concept, the amounts that are determined in the annexed tables, notwithstanding that the company directly pays theAccommodation to the worker with an authorized establishment for this, in which case the expressed diets will not be accrued;Without prejudice to the above in those exceptional cases of excess in justified expenses, the employer will assume them.

    Article one4.- Plus of mileage

    The workers who have their work center outside the urban area of the populations in which they would have been hired, will perceive, as plus of mileage, the amount determined in the annexed tables per kilometer or fraction.This plus will be paid for each round trip, and provided that the worker uses his own vehicle for displacement.To determine the limit of the urban area of the populations, the provisions of municipal ordinances or in your case will be followed by what the competent administrative body determines.The Plus will be paid per kilometer traveled, when the worker displacements on the commission of the company, with his own vehicle, unless otherwise agreed by the parties.The reference plus will be increased by the same percentage and on the same dates in which the base salary is reviewed.

    Article one5.- Inapplication clause

    Said agreement must be communicated to the Joint Commission within ten days since its formalization.In terms of inapplication on the system of remuneration and salary amount, if during the consultation period the parties reach an agreement, the parties are obliged to agree on a program of the progressive convergence to the recovery of the salary conditions losses during the period of inapplication.

    On the other hand, in case of disagreement during the consultation period, the parties must submit the discrepancy to the joint commission of the agreement, as a mandatory condition and in any case, always prior to the appeal to the mediation and arbitration procedures.The Commission will have a maximum period of seven days to rule from the fact that the discrepancy was raised.

    When an agreement had not been reached within the aforementioned commission, the parties must resort to the mediation procedures and, where appropriate, arbitration, provided for in the III Asac, and if after these procedures the disagreement persisted, any of the partiesmay submit the solution of the discrepancies to the Regional Advisory Commission of Collective Agreements, regulated in Law 8/2008of Castilla-La Mancha, which must be pronounced on a matter submitted within a maximum period of25days from the date of the date of the date of the date of thesubmission of the conflict before said organ.

    Article one6.- More beneficial conditions

    Chapter IV Social Improvements

    Article one7.- Complementary benefits to Social Security

    Article one8.- Early retirement

    The companies and workers affected by this agreement, and provided that the latter request it, will be forced to comply with the provisions of early retirement, as well as the provisions of partial retirement and the relief contract, all in accordance with the criteria and criteria andlegally set requirements at the time of application.

    Article one9.- Accumulation of breastfeeding permit

    In the assumptions of child birth, adoption, keep for adoption or foster care in accordance with article 45.one.d) of the Statute of Workers, for the breastfeeding of the minor until it turns nine months, the working people will be entitled to an hour of absence of work, which will be chosen by them in accordance with their needs and that they can divide into two fractions.The duration of the permit will be increased proportionally in cases of childbirth, adoption, keeps multiple adoption or foster care purposes.

    When both parents, adopters, guardians or welcoming exercise this right with the same duration and regime, the period of enjoyment may extend until the infant turns twelve months, with proportional reduction of the salary from the fulfillment of the nine months.

    Chapter V Hiring

    Article20.- eventual contract

Para asegurar mínimamente la calidad en el empleo se establece el compromiso por parte de la patronal de no superar el límite del one5% de contratación eventual en el conjunto del sector, estableciendo fórmulas correctoras especiales para la microempresa.

    Article2one.- Contract for training and learning

En virtud de lo dispuesto en el artículo oneone.2del ET, y su desarrollo, la utilización del contrato para la formación y el aprendizaje en este Convenio, tendrá por objeto la cualificación profesional de los trabajadores en un régimen de alternancia de actividad laboral retribuida en una empresa con actividad formativa recibida en el marco del sistema de formación profesional para el empleo o del sistema educativo.

    En lo no previsto, se estará en lo dispuesto en el artículo oneone.2del ET.

    Article22.- Training contract

    En virtud de lo dispuesto en el artículo oneone.onedel ET, y su desarrollo, podrá concertarse con quienes estuvieren en posesión de título universitario o de formación profesional de grado medio o superior, o títulos oficialmente reconocidos como equivalentes de acuerdo con las normas reguladoras del sistema educativo vigente en cada momento, o de certificado de profesionalidad de acuerdo con lo establecido en la Ley 5/2002, que habiliten para el ejercicio profesional dentro de los cinco años o de siete años cuando el contrato se concierte con un trabajador con discapacidad, siguientes a la terminación de los correspondientes estudios, de acuerdo con las siguientes reglas:

    En lo no previsto, se estará en lo dispuesto en el artículo oneone.onedel ET.

    Article23.- Alternatives to the creation of the job

    3.º Extraordinary hours para pedidos o períodos punta de producción, ausencias imprevistas, cambio de turno, entregas perentorias o urgentes y otras circunstancias de carácter estructural derivadas de la naturaleza de la actividad de que se traten, se mantendrán siempre que no quepa la utilización de las distintas modalidades de contratación previstas por la ley, considerándose, por tanto, estructurales.

    4.º Aquellas empresas que en cómputo anual realicen más de mil quinientas horas extraordinarias (dentro de una misma categoría profesional o grupo homogéneo de trabajadores), vienen obligadas a la creación de un nuevo puesto de trabajo por cada mil quinientas horas realizadas.

    5.º La dirección de la empresa informará mensualmente al Comité de Empresa, a los delegados de personal y delegados sindicales sobre el número de horas extraordinarias realizadas, especificándose las causas y en su caso la distribución por secciones.Likewise, the company and the legal representatives of the workers will determine the character and nature of the hours as established in article 35.5del Estatuto de los Trabajadores se registrarán día a día y se totalizarán mensualmente, entregándose copia semanal al trabajador en el parte correspondiente.

    CHAPTER VI LABOR HEALTH

    Article26.- Occupational health

    one.º Las empresas entregarán a sus trabajadores un mono o prenda adecuada de trabajo cada seis monthes; así mismo, se estará a lo dispuesto en la Ley de Prevención de Riesgos Laborales.

    2.º En los centros de trabajo donde existan delegados de prevención, estos se reunirán con la empresa para promover y asegurar las observancias de las disposiciones vigentes de la Ley de Prevención de Riesgos Laborales.

    3.º Las reuniones en materia preventiva serán periódicas y a requerimiento de cualquiera de las partes.

    4.º Los delegados de prevención y miembros del Comité de Salud dispondrán de un crédito de 30 horas anuales destinadas a recibir la formación en el ámbito de su responsabilidad como delegados de prevención.

    Capítulo VII Clasificación Profesional, Código Conducta Y Training

    Article28.- Professional classification system

    General criteria.

    D) Responsabilidad: Factor para cuya valoración deberá tenerse en cuenta tanto el grado de autonomía de acción del titular de la función, como el grado de influencia sobre los resultados e importancia de las consecuencias de la gestión.

    E) Mando: Factor para cuya valoración deberá tenerse en cuenta:

    F) Complejidad: Factor para cuya valoración se estará en función del mayor o menor número, así como del mayor o menor grado de integración del resto de los factores en la tarea o puesto encomendado.

    Article29.- Structure Labor Code

    El acuerdo sobre código de conducta laboral para la industria del metal ha sido negociado y suscrito al amparo de lo dispuesto en el título III del Estatuto de los Trabajadores y más concretamente de los artículos 83y 84de dicho texto legal, en desarrollo de lo pactado en el Convenio Colectivo Estatal de la Industria, lay los Servicios del Sector del Metal (CEM).

    During this process, which must be substantiated within a maximum period of ten days, all actuators will save an absolute confidentiality and reserve, by directly affecting the intimacy and honorability of the people.

    The procedure must be agile and fast, grant credibility and protect the intimacy, confidentiality and dignity of the affected people.In the case of sexual harassment or by reason of sex they will lead to timely disciplinary sanctions.

    The regulation of this action protocol does not prevent companies included in the scope of this Collective Agreement, negotiating other specific measures, procedures or protocols to use internally in this matter.In the absence of an action protocol in cases sexual harassment and by reason of sex within the company, the present will apply.

    DISPOSICIONES ADICIONALES

    First Additional Provision.- Generic use of language

    Third Additional Provision.- National or regional agreements

    Las partes firmantes acuerdan que si durante la vigencia del presente Convenio, se firmaran, en el ámbito nacional o autonómico, acuerdos en relación con el artículo one5del presente «cláusula de inaplicación», las partes se reunirán en el plazo máximo de dos monthes para adaptar la nueva regulación al presente Convenio.
