The Family Court of Logroño confirmed on Monday that two babies were exchanged at the former San Millán Hospital in Logroño in 2002, once the results of a DNA test have been received from one of the parents, according to judicial sources and as reported by the newspaper La Rioja.
The two girls were born in this defunct hospital in the capital of Riojana on the same day, five hours apart; they both needed to be in the incubator and, apparently, when they moved into the crib area, they were exchanged and handed over to the wrong parents.
The DNA test corresponds to the biological father of the girl who, in 2017, together with her grandmother, who had raised her, filed a food lawsuit against whom she thought she was her father, although she claimed that she was not her daughter.
The Family Judge ordered, on that date, a paternity test to the defendant, which confirmed that he was not his biological father. Later, it was revealed that the one she believed to be the biological mother of this minor was neither, according to a DNA test that was performed on her not related to this case.
This girl, who was then 15 years old, sought to ascertain her identification in accordance with the principle of biological veracity. The Health Department opened an investigation and attributed this exchange of babies to a human error, according to its headline, Sara Alba, on September 7.
The newspaper La Rioja reported on Monday that last October 14, the hearing was held in the Palace of Justice in La Rioja, behind closed doors, by the filiation procedure promoted by this young woman to be legally recognized as the daughter of her biological parents (the mother died in 2018).
He also adds that the sentence implies that in the Civil Registry, as of Monday, the young woman appears as the daughter of her true parents. This young woman claimed three million euros from the Health Department for moral damages, and the autonomous administration offered 215,000 euros.
