Paternity and maternity leave will be six months from next year. It is one of the star measures of the future family diversity law, the main lines of which were presented this Wednesday by the Minister of Social Rights and the 2030 Agenda, Ione Belarra. A project in which he is working with the Ministry of Equality.
In the case of single-parent families (in eight out of ten cases the parent is female) the two permits can be accumulated. That is, it will be one year. This case already has some precedent. A court in Valencia recognized last May the right of a mother to enjoy, after giving birth, both permits cumulatively.
Currently, paternity and maternity leave are equivalent and last 16 weeks.
The law also plans to include, “as one of its key measures”, a universal parenting benefit that “allows families in our country to raise their children and daughters with dignity, guaranteeing better material living conditions”, according to sources from Podemos, the government party.
The amount of the new benefit will be revealed when the 2022 Budgets are presented. Minister Belarra has insisted that the universal child-rearing benefit will not depend "on the family's checking account."
Waiting to find out how the new permit is finalized -the minister has specified that it is a proposal that she makes from her ministry and that will have to be discussed within the Government-, until now, to apply for the permission of paternity it is necessary to meet the following requirements:
1. Be affiliated and registered or in a situation assimilated to registration.
2. Have covered a minimum contribution period based on age. In this way, if the applicant is under 21 years of age, a minimum contribution period will not be required. In the event that you are between 21 and 26 years old, you will have to have contributed 180 days throughout your working life or 90 days within the seven years immediately prior to the start of the leave. If you have already reached 26 years of age, you must have contributed 180 days within the seven years immediately prior to the start of the leave or 360 days throughout your entire working life.
3. Comply with the payment of the quotas for which the workers are directly responsible.
To process the paternity or maternity benefit, it is necessary to present the last payslip, a photocopy of the DNI, the updated family book, the bank receipt in which it must be paid the remuneration, the paternity report from the health service, the leave request sent to the company and the official model of the paternity request.
The collection will occur after the second week of the month following the generation of the right.
During the leave, 100% of the usual salary is received, with all the concepts of the regulatory base, normally included in all the complements assigned in the payroll.
In the case of opting for maternity/paternity through adoption or wanting to participate in a foster service, it is possible to request permission as long as the adoptee or foster is under 6 years old. It may also be requested if the children are between 6 and 18 years old and suffer from some type of disability with a degree equal to or greater than 33% or who, due to their circumstances and personal experiences, may experience difficulties when it comes to integrating socially and with the family.
